Dreambuilders Church Mobile Application

Agreement to Terms

By downloading, installing, or using the Dreambuilders Mobile Application (the “App”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and Dreambuilders Church (“we”, “us”, “our”, “Church”) regarding your use of the App.

About the App

The Dreambuilders Mobile App is a free application developed to serve our church community by providing access to:

  • Live streaming services and events
  • Sermon recordings and archives
  • Bible reading and study tools
  • Personal note-taking capabilities
  • Service roster information (for members)
  • Church announcements and events
  • Giving platform integration
  • Church location and contact information

Acceptance and Eligibility

Who Can Use the App

  • The App is designed for members and friends of Dreambuilders Church
  • Users must be at least 13 years old to create an account
  • Users under 18 should have parental consent
  • Guest users can access public content without creating an account

Account Creation

  • You may create an account to access additional features
  • You are responsible for maintaining the confidentiality of your account credentials
  • You must provide accurate and complete information when creating an account
  • You are responsible for all activities that occur under your account

Acceptable Use

You May

  • Use the App for personal spiritual growth and church engagement
  • Share publicly available content (sermons, Bible verses) in accordance with copyright laws
  • Connect third-party services (Elvanto, OneNote) for personal use
  • Provide feedback and suggestions for App improvements

You May Not

  • Use the App for any unlawful purpose or in violation of these Terms
  • Attempt to gain unauthorized access to the App’s systems or other users’ accounts
  • Upload, transmit, or distribute any content that is harmful, offensive, or inappropriate
  • Reverse engineer, decompile, or attempt to extract the source code of the App
  • Use the App to send spam, chain letters, or other unsolicited communications
  • Interfere with or disrupt the App’s functionality or servers
  • Use automated systems (bots, scrapers) to access the App
  • Violate any applicable local, national, or international laws

User Content

Your Notes and Data

  • You retain ownership of any notes, content, or data you create using the App
  • You grant us a limited license to store and process your content to provide App services
  • You are solely responsible for your content and its appropriateness
  • We reserve the right to remove content that violates these Terms

Third-Party Content

  • The App may contain content from third parties (sermons, Bible translations, etc.)
  • We respect intellectual property rights and expect users to do the same
  • If you believe content infringes your rights, contact us at legal@dreambuilders.church

Third-Party Integrations

Elvanto Integration

  • Connecting to Elvanto is optional and requires your separate Elvanto account
  • We are not responsible for Elvanto’s services or any issues with your Elvanto account
  • Elvanto’s terms of service and privacy policy apply to your use of their services

Microsoft OneNote Integration

  • Connecting to OneNote is optional and requires your Microsoft account
  • We are not responsible for Microsoft’s services or any issues with your OneNote account
  • Microsoft’s terms of service and privacy policy apply to your use of their services

Tithely Giving Platform

  • Giving through the App redirects you to Tithely’s secure platform
  • We do not process, store, or handle any financial transactions
  • Tithely’s terms of service and privacy policy apply to all giving transactions
  • All giving is voluntary and non-refundable unless required by law

App Availability and Modifications

Service Availability

  • We strive to keep the App available 24/7 but cannot guarantee uninterrupted service
  • The App may be temporarily unavailable due to maintenance, updates, or technical issues
  • We reserve the right to modify, suspend, or discontinue the App at any time

Updates and Changes

  • We may update the App to add features, fix bugs, or improve performance
  • Updates may be automatically downloaded and installed on your device
  • We may modify these Terms at any time by posting revised Terms in the App
  • Continued use of the App after changes constitutes acceptance of new Terms

Intellectual Property

Our Rights

  • The App, including its design, features, and underlying technology, is owned by Dreambuilders Church
  • All trademarks, logos, and brand names are our property or used with permission
  • You may not use our intellectual property without written permission

Third-Party Rights

  • Bible translations, sermon content, and other materials may be owned by third parties
  • You must respect all applicable copyright and intellectual property laws
  • Fair use provisions may apply to certain educational and personal uses

Privacy and Data Protection

Your privacy is important to us. Our data collection and use practices are governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the App, you consent to our Privacy Policy.

Disclaimers and Limitations

Spiritual Content Disclaimer

  • The App provides access to spiritual and religious content for informational purposes
  • Content should not replace personal Bible study, pastoral counseling, or professional advice
  • We make no representations about the completeness or accuracy of spiritual interpretations

Technical Disclaimers

  • The App is provided “as is” without warranties of any kind
  • We do not warrant that the App will be error-free or continuously available
  • We are not responsible for data loss, though we strive to protect your information

Limitation of Liability

To the maximum extent permitted by Australian law:

  • Our liability is limited to the cost of the App (which is free)
  • We are not liable for indirect, incidental, or consequential damages
  • Our total liability shall not exceed AU$100
  • These limitations do not apply to liability for death, personal injury, or fraud

Indemnification

You agree to indemnify and hold harmless Dreambuilders Church, its staff, volunteers, and affiliates from any claims, damages, or expenses arising from:

  • Your use of the App
  • Your violation of these Terms
  • Your violation of any third party’s rights
  • Any content you submit through the App

Termination

Your Rights

  • You may stop using the App at any time
  • You may delete your account through the App settings
  • Uninstalling the App terminates your use

Our Rights

We may suspend or terminate your access to the App if you:

  • Violate these Terms
  • Use the App inappropriately
  • Engage in conduct harmful to the Church or other users
  • Fail to comply with applicable laws

Effect of Termination

  • Upon termination, your right to use the App ceases immediately
  • We may delete your account and associated data after reasonable notice
  • Provisions regarding liability, indemnification, and dispute resolution survive termination

Governing Law and Dispute Resolution

Applicable Law

These Terms are governed by the laws of the Northern Territory of Australia, without regard to conflict of law principles.

Jurisdiction

Any disputes arising from these Terms or the App shall be subject to the exclusive jurisdiction of the courts of the Northern Territory of Australia.

Dispute Resolution Process

Before initiating legal proceedings, you agree to:

  • Contact us directly at perth@dreambuilders.church to attempt resolution
  • Engage in good faith negotiations for at least 30 days
  • Consider mediation through a mutually agreed mediator

General Provisions

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the App.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

No Waiver

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision.

Assignment

You may not assign your rights under these Terms. We may assign our rights to any affiliate or successor organization.

Force Majeure

We are not liable for any failure to perform due to circumstances beyond our reasonable control, including natural disasters, government actions, or technical failures.

Church Community Standards

As a church-based application, we encourage users to:

  • Treat all community members with respect and kindness
  • Use the App in a manner consistent with Christian values
  • Support and encourage one another in faith
  • Report any inappropriate behavior or content

Age-Appropriate Content

The App is designed to be family-friendly and appropriate for all ages. We strive to ensure all content meets community standards for decency and appropriateness.

  • Continued use of the App after changes constitutes acceptance of the updated Terms
